Welcome to AccordSign (“we”, “us”, “our”). These Terms & Conditions, along with our Privacy Policy, Security Statement, and related policies (collectively, the “Agreement”), govern your use of our applications, website, API, and e-signature services (“Service”).

By using AccordSign, you agree to this Agreement. If you do not agree, please stop using the Service.


1. About AccordSign

AccordSign is an e-signature and document workflow tool that lets users upload files, place signature fields, send documents for signing, and track activity.

We do not provide legal, financial, or professional advice.

We do not validate or verify the identity, intent, or authority of any signer.

You are responsible for ensuring your use of electronic signatures complies with applicable law.


2. Eligibility

You must be:

• At least 18 years old

• Legally capable of entering into binding agreements

If you operate on behalf of a business, you confirm you are authorised to bind that organisation.


3. Account Responsibilities

You are responsible for:

• Keeping your credentials secure

• All activity in your account

• Providing accurate information

We may suspend or terminate accounts that appear compromised or violate this Agreement.


4. Electronic Signatures

AccordSign enables preparation, sending, and collection of digital signatures. You control:

• What documents you upload

• Who receives them

• Whether signatures are legally valid for your purpose

AccordSign does not act as a notary, legal certifier, identity verifier, or witness.

Document enforceability depends on your jurisdiction and compliance.


5. Document Storage & Security

We use secure cloud infrastructure and industry-grade encryption. However:

• No system can guarantee 100% security

• You are responsible for retaining your own backups

• Storage limits may apply per plan

Signed documents may be stored temporarily for service functionality.


6. Your Content

You own all documents, files, templates, and user-generated content (“Content”).

You grant AccordSign a limited licence to:

• Store your files

• Process them for signature workflows

• Provide audit trails and logs

We do not claim ownership.

We do not sell or use content for AI training.

You may not upload illegal, fraudulent, or harmful material.


7. Payment, Credits & Subscriptions

We offer individual pay-as-you-go credits and business subscriptions.

By purchasing, you agree:

• All payments are final and non-refundable

• Credit packs have validity periods

• Subscription renewals may be billed automatically

• Taxes may apply

• Pricing may be updated with notice

You can manage billing via your account dashboard.


8. Acceptable Use

You agree not to use AccordSign to:

• Break the law

• Upload harmful code

• Forge signatures or impersonate others

• Harass recipients or misuse data

• Reverse-engineer the platform

Violations may lead to suspension or legal action.


9. No Legal Advice & No Liability

AccordSign is a technical platform. We do not guarantee that:

• A signature is valid in every jurisdiction

• Documents will be legally enforceable

• The service will be uninterrupted or error-free

• Compliance obligations for your industry are automatically met

To the maximum extent permitted by law, AccordSign is not liable for:

• Loss of data

• Damages from use or inability to use the Service

• Disputes between senders and signers

• Legal consequences arising from document use

You use the Service at your own risk.


10. Warranty Disclaimer

The Service is provided “as is” and “as available” with no warranties of any kind.


11. Termination

We may suspend or terminate your account if:

• You violate this Agreement

• We detect misuse or fraud

• Law enforcement requests it

You may stop using the service anytime.

Termination does not cancel outstanding charges.


12. Privacy Policy

12.1 Information We Collect

• Account details (name, email, phone)

• Documents and uploaded files

• Signer information

• Payment and billing details

• Device, browser, IP, and analytics data

12.2 How We Use Data

• Operate and improve the Service

• Send signature requests & notifications

• Provide audit logs

• Process payments

• Customer support

We do not sell personal information.

We do not use documents or signatures for AI training.

12.3 Sharing

We share limited information only with:

• Cloud hosting providers

• Payment gateways

• Email/SMS providers

• Fraud detection tools

• Regulators (when required by law)

12.4 Your Rights

You may:

• Request access or deletion of your data

• Update account information

• Close your account

• Request a data export

13. Security Statement

We use:

No platform can be 100% secure, but we follow industry best practices.


14. Refund & Cancellation Policy

AccordSign does not issue refunds for:

• Credit packs

• Monthly subscriptions

• Annual subscriptions

• Auto-renewals (if billing info was valid)

Cancellations stop future billing but do not refund previous payments.

Users are encouraged to monitor credit usage and plan renewals.


15. Data Processing Addendum (DPA) – Summary

For users subject to GDPR or similar regulations:

• AccordSign acts as a “Data Processor” for documents you upload

• You are the “Data Controller”

• We process data only according to your instructions

• Sub-processors are reviewed for compliance

• We maintain logs, encryption, and technical safeguards

• You may request a signed DPA via email


16. ESIGN / eIDAS / HIPAA Compliance Overview

16.1 ESIGN (U.S.)

AccordSign supports electronic signatures consistent with ESIGN and UETA requirements:

• Intent to sign

• Consent to electronic records

• Association of signature with record

• Audit trails

• Document integrity

16.2 eIDAS (EU)

AccordSign supports “Advanced” e-signature requirements but is not a Qualified Trust Service Provider (QTSP).

Users must ensure their use case complies with eIDAS classifications.

16.3 HIPAA (U.S. Healthcare)

AccordSign supports secure document handling but does not act as a Business Associate unless a separate BAA is signed.

Users must manage PHI responsibly.


17. Short “Terms of Use” Summary (for footer links)

AccordSign provides e-signature tools. By using the service, you agree not to misuse the platform and acknowledge that AccordSign does not offer legal advice or guarantee enforceability of documents. Your data is handled per our Privacy Policy. Payments are non-refundable. Use at your own risk.


18. Changes to This Agreement

We may update this Agreement from time to time.

Significant changes will be communicated via email or product notifications.

Continued use indicates acceptance.


19. Governing Law

This Agreement is governed by the laws of India.

Disputes will be resolved in the courts of Ahmedabad, Gujarat, unless mutually agreed otherwise.
